7.1 Relationship with Shopify
Our stores are hosted by Shopify, which collects and processes personal information about your access to and use of our stores in order to provide and improve its services. Information you submit will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside.
In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our stores, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our stores, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes.
To learn more about how Shopify uses your personal information, visit the Shopify Consumer Privacy Policy. You may also exercise certain rights with respect to your personal information via the Shopify Privacy Portal.
8. Data retention
We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to complete transactions, maintain your account, provide customer support, comply with legal obligations, resolve disputes, and enforce our agreements. We retain personal information for no longer than is necessary for the purposes for which it was collected.
If you request deletion of your personal information, we will process your request in accordance with applicable law, though we may retain certain information as required for legal, tax, or compliance purposes.
9. Data security
We take reasonable technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. Our stores use SSL/TLS encryption to secure data transmitted between your browser and our servers. Payment information is processed securely through our payment providers and is never stored on our servers.
However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.
10. Your privacy rights
Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. These rights are not absolute, may apply only in certain circumstances, and in certain cases we may decline your request as permitted by law.
10.1 Rights available to all users
- Right to Access / Know: Request access to the personal information we hold about you, including the categories and specific pieces of information collected.
- Right to Delete: Request deletion of personal information we maintain about you, subject to certain legal exceptions.
- Right to Correct: Request correction of inaccurate personal information we maintain about you.
- Right of Portability: Request a copy of your personal information in a portable, readily usable format so that you can transfer it to another entity. You may also obtain and reuse your personal data for your own purposes across different accounts.
- Right to Withdraw Consent: Where we rely on your consent to process your personal information, you may withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.
- Right to Object or Restrict Processing: You may have the right to object to or request that we restrict certain processing of your personal information.
- Managing Communication Preferences: You may opt out of receiving promotional emails at any time by using the unsubscribe option in our emails. If you opt out, we may still send you non-promotional emails such as order confirmations and shipping updates.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.
10.2 Additional rights for U.S. residents
If you are a resident of the United States, the following additional rights and disclosures apply:
Right to Opt-Out of Sale or Sharing
We share certain personal information — such as device identifiers, cookie identifiers and browsing activity — with advertising partners so they can show you Rokoko ads on other websites and platforms. Under the CCPA/CPRA and comparable laws in Colorado, Connecticut, Virginia and other states, this may be considered a "sale" or "sharing" of personal information, even though no money changes hands.
You can opt out at any time:
- https://us.store.rokoko.com/pages/data-sharing-opt-out — takes effect immediately. You do not need an account, and we do not need to verify your identity.
- Email us at hi@rokoko.com with the subject "Opt-out of sale or sharing" if you would prefer we process your request manually, or if you want your choice applied to your customer account and past orders rather than a single browser.
An opt-out made through the link above applies to the browser and device you are using. If you use more than one browser or device, or clear your cookies, you will need to opt out again on each. To apply your choice across your account, use the email method.
Global Privacy Control. If your browser or extension sends a Global Privacy Control (GPC) signal, we treat it as a valid request to opt out of the sale or sharing of your personal information, and you do not need to take any further action.
Authorized agents. You may designate an authorized agent to submit an opt-out request on your behalf. We may ask the agent for proof of authorization and may ask you to confirm the agent's authority directly.
No discrimination. Opting out will not affect your access to our stores, the prices you pay, the products available to you, or the service you receive.
CCPA/CPRA Disclosures (California Residents)
If you are a California resident, the CCPA/CPRA provides you with additional rights. In the preceding 12 months, we have collected the following categories of personal information:
- Identifiers (name, email, address, IP address)
- Commercial information (purchase history, products purchased including size)
- Internet or electronic network activity (browsing history, interactions with our stores)
- Geolocation data (approximate location derived from IP address)
- Financial information (payment details, transaction information)
We share certain categories of personal information — specifically identifiers and internet or electronic network activity — with advertising partners including Meta and Google for cross-context behavioural advertising. Under the CCPA/CPRA this constitutes "sharing", and may constitute a "sale". You may opt out at any time using the https://us.store.rokoko.com/pages/data-sharing-opt-out link, which is also available in the footer on our US store.
We do not knowingly sell or share the personal information of consumers under 16 years of age.
We do not use or disclose sensitive personal information for purposes other than those permitted under the CCPA/CPRA, and therefore do not offer a separate right to limit its use.
Virginia, Colorado, Connecticut, and Other State Residents
Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), and other states with comprehensive privacy laws may have similar rights to access, delete, correct, and opt out of certain data processing activities. If we deny your request, you may have the right to appeal. To appeal, please contact us at hi@rokoko.com with the subject line "Privacy Rights Appeal."
10.3 Additional rights for EEA, UK, and Swiss residents
If you are located in the European Economic Area, United Kingdom, or Switzerland, you have the following additional rights under the GDPR and UK GDPR:
- Right to lodge a complaint: You have the right to lodge a complaint with your local data protection authority. As Rokoko Electronics ApS is established in Denmark, EEA customers may also contact the Danish Data Protection Agency (Datatilsynet).
- Right to restrict processing: You may request that we restrict the processing of your personal information in certain circumstances, such as when you contest the accuracy of the data or object to our processing.
- Right to object to legitimate interests processing: Where we process your data based on legitimate interests, you may object to such processing and we will cease processing unless we demonstrate compelling legitimate grounds that override your interests, rights, and freedoms.
For information about how we transfer your data internationally, including safeguards such as Standard Contractual Clauses, see Section 12 (International Data Transfers).
10.4 How to exercise your rights
To submit a privacy rights request, please contact us at:
Email: hi@rokoko.com
We will verify your identity before processing your request. We will respond to your request within the timeframe required by applicable law (45 days under CCPA; one month under GDPR, extendable by two further months where necessary). If we need additional time, we will notify you of the extension and the reason.
In accordance with applicable law, you may designate an authorized agent to make requests on your behalf to exercise your privacy rights. Before accepting such a request from an agent, we will require that the agent provide proof that you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.
11. Children’s privacy
Our stores and services are not intended to be used by children, and we do not knowingly collect personal information from children under the age of 13 (in the United States) or under the applicable digital consent age in your jurisdiction (between 13 and 16 in the EEA, depending on country). Our products (motion capture hardware and software) are designed for professional and adult use.
If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details below to request that it be deleted. As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.
12. International data transfers
Rokoko operates globally, and your personal information may be transferred to, stored, and processed in countries other than where you reside. In particular, data may be transferred between the United States and Denmark/the European Economic Area, depending on which Rokoko entity and services you interact with.
If we transfer your personal information out of the European Economic Area or the United Kingdom, we will rely on recognized transfer mechanisms such as the European Commission’s Standard Contractual Clauses (SCCs), or any equivalent contracts issued by the relevant competent authority of the UK, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
Where we transfer personal information internationally, we put safeguards in place to ensure your information remains protected in accordance with applicable data protection standards. By using our stores and services, you acknowledge that your information may be transferred internationally as described in this section.
13. Opt-out preference signals
Global Privacy Control (GPC). Some browsers and browser extensions transmit a Global Privacy Control signal indicating that you wish to opt out of the sale or sharing of your personal information. We treat a GPC signal received on our stores as a valid opt-out request for that browser and device, as required by the CCPA/CPRA and comparable laws in Colorado and Connecticut.
Do Not Track (DNT). Some browsers transmit a "Do Not Track" signal. Because there is no industry-standard interpretation of DNT, we do not currently respond to it. We will update this policy if a standard is adopted.
14. Third-party links
Our stores and services may contain links to websites or online platforms operated by third parties. If you follow links to sites not affiliated with or controlled by us, you should review their privacy and security policies. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on them. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms, may be viewable by other users without limitation as to its use. Our inclusion of such links does not imply endorsement of the content on such platforms or of their operators.
15. Changes to this privacy policy
We may update this Privacy Policy from time to time, including to reflect changes in our practices, technology, legal requirements, or other operational or regulatory reasons. When we make changes, we will update the "Last Updated" date at the top of this page and provide notice as required by applicable law. Your continued use of our stores and services after any changes constitutes your acceptance of the updated Privacy Policy.
16. Contact us
If you have any questions, concerns, complaints, or requests regarding this Privacy Policy or our data practices, please contact us:
